<p><strong>PREAMBLE</strong></p>



<p>The 1st National Kongamano of the Kongamano la Mageuzi movement was convened on the 12th and 13th of December 2020 under the theme “ Rising from the Ashes of Betrayal: From Victims to Citizens”&nbsp; &#8211; hence presenting cadres in our movement an opportunity for introspection on the values, reasons and objectives of our movement and our shared dreams for the future of our motherland, Kenya.&nbsp;</p>



<p><br><strong>RESOLUTIONS</strong></p>



<p><em>In asserting</em> our sovereignty as citizens of Kenya, our natural rights in defense of our freedoms and in the ongoing struggle to protect and defend the Constitution of the Republic of Kenya;</p>



<p><em>In honoring</em> the struggles of our forebears in defense of these natural rights, freedoms and obligations conferred as citizens of the Republic of Kenya by our Constitution;</p>



<p><em>In reminding</em> those individuals to whom the 48 million Kenyans have delegated&nbsp; their exercise of democratic power, that the people of Kenya have always risen up and asserted their sovereign will, despite the country’s leadership’s disregard of this solemn responsibility and their disregard for the rule of law;&nbsp;</p>



<p><em>In exercising </em>our sovereign will as citizens of Kenya we resolve that:&nbsp;</p>



<ol class="wp-block-list"><li><em>We assemble</em> pursuant to our Constitutional rights and freedoms; and representing but not limited to diverse individual pursuations, political parties and movements, grassroots organisations, civil society groups, religious communities, professional associations&nbsp; and trade unions, legitimate business people and entrepreneurs, student and other youth movements, in common opposition to the affront on the sovereign will of the citizens of Kenya and the Constitution of Kenya; and with the intent to reassert by all means necessary within the bounds of our natural rights as human beings and our rights and freedoms guaranteed by the Constitution as citizens of the Republic of Kenya;</li></ol>



<ol class="wp-block-list" start="2"><li><em>We reject</em> all and any illegitimate attempts to subvert the Constitution of Kenya and the sovereign will of its citizens, including through the illegal Building Bridges Initiative;&nbsp;&nbsp;</li></ol>



<ol class="wp-block-list" start="3"><li><em>We endorse</em> a common Interim Charter that lays out our ideological basis and objects of reason that we intend to continue to progressively refine through comments and recommendations made at this Kongamano and through public participation and engagement at the grassroots level;</li></ol>



<ol class="wp-block-list" start="4"><li><em>We commit</em> to developing a progressive Manifesto and Program of Action to transform the economic, social and political landscape in Kenya;&nbsp;</li></ol>



<ol class="wp-block-list" start="5"><li><em>We identify</em> with the collective social, economic and political struggles of the <em>mwanainchi </em>who have suffered from the misrule of successive neo colonial governments that have betrayed the aspirations of the Kenyan people;</li></ol>



<ol class="wp-block-list" start="6"><li><em>We associate</em> with kindred social justice movements in Africa and globally</li></ol>



<ol class="wp-block-list" start="7"><li><em>We adopt</em> a united and democratic political platform for nomination of candidates for Presidential, Parliamentary and County elections under the KLM United Front;</li></ol>



<ol class="wp-block-list" start="8"><li><em>We recommend</em> as a national priority and as collective solutions to the perennial challenges bedevilling&nbsp; Kenya the full implementation of ;&nbsp;&nbsp;<ol><li>&nbsp;&nbsp;The Constitution of Kenya of 2010</li><li>&nbsp;&nbsp;The Recommendations of the Kriegler Report of 2008</li><li>&nbsp;The Report of the Kenya National Dialogue Conference: Building a&nbsp; Progressive Kenya of 2011</li><li>&nbsp;&nbsp;The Report of the Truth Justice and Reconciliation Report of 2011</li><li>&nbsp;The Report of the Illegal and Irregular Allocation of Public Land of 2004</li><li>&nbsp;The Report of the Judicial Commission Appointed to Inquire into&nbsp; Tribal Clashes in Kenya of 1999, the Waki Report of 2008</li><li>&nbsp;The Report on the National Taskforce on Police Reforms and the Report of The Commission of Inquiry into the Educational System in Kenya of 1999&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;</li></ol></li></ol>



<ol class="wp-block-list" start="9"><li><em>We form </em>ourselves as a coalition of willing Kenyans, organized as citizen initiatives and entities; in pursuit of common political objectives defined in our interim collective Charter, Manifesto and these Resolutions;</li></ol>



<ol class="wp-block-list" start="10"><li><em>We invite</em> like-minded individuals, political parties, grassroots organisations, civil society groups, religious communities, political formations, professional associations, trade unions, special interest groups not limited to youth, persons with disabilities, women, pastoralists and other marginalized groups; to join our movement as equal comrades in the struggle for the new Kenya We Want;&nbsp;</li></ol>



<ol class="wp-block-list" start="11"><li><em>We commit </em>to engage together in good will, patriotism and in common interest under our various declarations and instruments;</li></ol>



<ol class="wp-block-list" start="12"><li><em>We endorse </em>our Interim Coalition Organs in preparation for transformational change; and entrust the Interim Steering Committee of KLM to finalize the mechanisms for their set-up and inauguration at the 2nd Kongamano;&nbsp;</li></ol>



<ol class="wp-block-list" start="13"><li><em>We commit</em> to upholding the rule of law in strict adherence to constitutional and legally mandated timelines, principles and prescriptions for contesting elections in Kenya;</li></ol>



<ol class="wp-block-list" start="14"><li><em>We recognize </em>that the foregoing Resolutions, our Charter, our Structures and our Manifesto are progressive documents and positions that require the input, refinement and opinions of the mwananchi and our diverse coalition partners.</li></ol>

<p>Ten years ago, when we promulgated the 2010 Constitution, we were hopeful that we had turned a page from the gross violations of human rights witnessed in colonial and post-colonial Kenya.&nbsp;</p>



<p>There was euphoria of having the most progressive constitution in the world, with the full integration of the bill of rights and the Universal Declaration of Human rights, as its guiding instrument.</p>



<p>We were hopeful of a new Kenya, where all our civic, political, cultural and socio-economic rights would be respected and enjoyed. That we had signed a strong social contract to build this new Kenya. And that today, on International Human Rights Day, we would be celebrating these achievements.</p>



<p>Instead, the Jubilee administration has waged a war on the 2010 Constitution, the Bill of Rights and human rights defenders throughout the country.&nbsp;</p>



<p>Human rights are under siege our country.&nbsp;&nbsp;The rule of law is being undermined. The right to housing is violated routinely, as we have heard today from our compatriots living in Kariobangi. And yet the Jubilee administration lists housing as one of its so-called Big Four Agenda.&nbsp;</p>



<p>Kongamano La Mageuzi stands in solidarity with all of you here in Kariobangi and all Kenyans who have been rendered homeless by this administration. We honor all human rights defenders risking their lives to protect people in the face of rising repression from the Jubilee administration.</p>



<p>KLM wishes to remind Kenyans that the Jubilee administration has failed to live up to its own promises on even the basic rights. Millions of Kenyans continue to live in poverty with no food, clean water or access to healthcare, in the midst of a global COVID-19 pandemic.</p>



<p>The assault on the Constitution as exemplified by the so-called Building Bridges Initiative is only one of the latest examples of the callousness of this administration. That in the midst of a global pandemic and an economic crisis, politics is their priority. That as our brothers and sisters are abandoned here without proper housing, their priority is to further violate our human rights through an illegal and illegitimate BBI referendum.</p>



<p>Kongamano La Mageuzi reiterates our commitment to fight for our human rights. To fight for the protection and implementation of our hard-worn 2010 Constitution.&nbsp; At its First National Kongamano on 12-13 December 2020, KLM will outline a national agenda and programme for political and economic transformation and freedom with and for all Kenyans, with the full protection of all our human rights.</p>



<p>This is the fight for the soul of our country. Now more than ever, we need to come together to defend the Katiba and stand up for human rights &#8212; for everyone, everywhere.</p>

<p>The time for a transformational, pro-people alternative political leadership in Kenya has come. A narrow, extractive political elite has dominated government and state power since independence, but they have underdeveloped our country, including under-developing of all public goods. We do not want the reforms of these political elites. We want to take over power from them so that we can carry out the full implementation of the Constitution of Kenya and other radical reforms in the public interest.</p>



<h3 class="wp-block-heading">Representatives of the People</h3>



<p>KLM plans to field candidates for all elective seats all over Kenya to compete in the next general elections (2022 or earlier) and be elected as representatives of the sovereign people of Kenya, pursuant to the provisions relating to elections set out in the Constitution of Kenya. The suitable applicants shall be nominated to compete as candidates for the following delegated positions:</p>



<ol class="wp-block-list"><li>The President of Kenya and Deputy President</li><li>Member of the Senate</li><li>Member of the National Assembly</li><li>Women Representative</li><li>Governor and Deputy Governor</li><li>Member of County Assembly</li></ol>

<ol class="wp-block-list"><li>Obedience, faithfulness, respect and upholding of the Constitution of Kenya</li><li>Transformative, democratic and pro-people leadership</li><li>Good governance, trustworthy with public money and exercise of fiduciary responsibility</li><li>Adherence to the rule of law</li><li>Believes in devolution and the need to advance it</li><li>Respect to and promotion of public participation</li></ol>

<h3 class="wp-block-heading">Personal Attributes for the Task</h3>



<p>The suitable candidates shall have the following attributes</p>



<ol class="wp-block-list"><li>Is a citizen of Kenya</li><li>Is 18 years and above</li><li>Satisfies the provisions of Chapter 6&nbsp; of the Constitution of Kenya and specifically<ol><li>Article 75 (1) – Relating to public and private conduct</li><li>Article 76 2 (a) – Relating to having a bank account outside Kenya</li></ol></li><li>Has no history of&nbsp; having benefited from the proceeds of corruption&nbsp;</li><li>Is not suspected of corruption whether by association or conduct</li><li>Fulfils the requirement of any law relating to elections presently in force in Kenya</li><li>Has not been convicted of a criminal offence (except in the case of malicious prosecution by state agencies for pro-reform advocacy)</li><li>Is a people servant</li><li>Has no history of sexism, ethnic bigotry and associated backwardness</li></ol>

<p>On August 27, 2010, Kenya promulgated a progressive&nbsp;Constitution&nbsp;whose vision is social democracy. It’s a vision of the promotion and protection of the whole gamut of human rights; the equitable distribution of political power and the resources of society; and the creation of a nation out of different ethnic groupings.&nbsp;</p>



<p>The Constitution aims to bring an end to the organisation of politics through division; cement agreement on national values and principles; promote integrity in public and private leadership; and build depersonalised national institutions.<br><br>The struggle for a prosperous, democratic and stable Kenya is not over and despite having successfully fought for a new constitution, power is still largely imperial, exercised in a brutal and unaccountable manner by a political elite who have in the last decade taken every step to undermine it.</p>



<p>We have a duty and a responsibility to defend Kenya’s constitution and we must actively resist the schemes by the political class to hijack, mangle and wreck the it, and thus remove the checks that make the exercise of political power onerous. The constitutional product is only as good—and as secure—as the process that creates it.</p>



<p>In this regard, KLM will push for radical implementation of the constitution through aggressive civic education and will support and partner with political actors, movements and organisations who plead fidelity to the constitution as the true, sovereign will of the people.</p>

<p>For almost the entire period since Kenya’s independence on December 12, 1963, the country’s politics has been organised around divisions: Ethnic, religious, racial, regional, clan and gender, generational, pastoralists versus agriculturalists, and most recently, divisions driven by xenophobia.<br>But after Kenya promulgated a progressive&nbsp;Constitution&nbsp;on August 27, 2010, The Constitution aims to bring an end to the organisation of politics through division; cement agreement on national values and principles; promote integrity in public and private leadership, and build depersonalised national institutions and provide a framework for the equitable distribution of political power and the resources of society.<br>Devolution is a key pillar of the new constitution. Indeed, devolution has been good but is not yet great. Because of a hostile national government and endemic corruption in the counties, devolved governments have not performed optimally although, compared to the central government’s record of the last 50 years, they have made a big difference in people’s daily lives. Although devolution has been revolutionary, a combination of frustration from the top (especially from the Treasury the Devolution Ministry (particularly the first one) and the Provincial Administration) and the extremely poor and corrupt leadership of some governors have delayed the devolution dividends.</p>



<p>KLM is committed to strengthening devolution through civic education, lobby for laws and policies that cement equitable distribution of resources and will lend its voice and support to the Council of Governors’ demands for the arrears in development funds that the national government continues to refuse to disburse.</p>

<p>Corruption in Kenya is endemic. Institutions, which were designed for the regulation of the relationships between citizens and the State, are being used instead for the personal enrichment of public officials (politicians and bureaucrats) and other corrupt private agents (individuals, groups, and businesses).&nbsp;</p>



<p>This, despite the existence of anti-graft institutions, committees, working groups, task forces, units; drafted all the frameworks and policy papers; taken all the advice possible from multilaterals, bilaterals, NGOs, the private sector and others including churches; enacted all the laws and their subsidiaries; held all the conferences, summits, workshops and get-togethers possible, Kenya is still classified as one of the most corrupt States in the world.</p>



<p>Indeed, corruption persists in Kenya primarily because there are people in power who benefit from it and the existing governance institutions lack both the will and capacity to stop them from doing so.</p>



<p>Kongamano La Mageuzi is committed by strengthening these institutions to tackle corruption; advocate moral and legal sanction against the corrupt and will create a political and national culture where corrupt individuals are frowned upon and not celebrated as heroes.</p>



<p>This, despite the existence of anti-graft institutions, committees, working groups, task forces, units; drafted all the frameworks and policy papers; taken all the advice possible from multilaterals, bilaterals, NGOs, the private sector and others including churches; enacted all the laws and their subsidiaries; held all the conferences, summits, workshops and get-togethers possible, Kenya is still classified as one of the most corrupt States in the world.</p>

<p>Kenya’s food forecast over the next decades is troubling. It will need more food to cope with a growing population over the next decade. But, as this demand for food surges ahead, the increasing effects of climate change will make food production more difficult. Estimates are that global warming could cause a 10% &#8211; 20% reduction in overall food production.</p>



<p>Unless actions are taken to build up local food systems and reverse the growing reliance on imports of cereals and other staple foods, there will be a food crisis Time has been wasted on failed programmes and policies to support corporate agribusiness while doing little to effectively challenge the corporations that are dumping surplus food commodities, driving up global greenhouse gas emissions and destroying biodiversity.&nbsp;</p>



<p>KLM is committed to must urgently collaborate and partner with like-minded people to join forces to eliminate the dependence on food imports and realise food sovereignty in Kenya to respond to the climate crisis.</p>

<p>Never before has the country witnessed such a spectacular mismanagement of the economy. Kenya’s public debt has touched a high of Sh8.4 trillion and is quickly racing towards the Sh9 trillion ceiling as the government chalks up more borrowing in its fight against Covid-19. Kenya is teetering on the precipice of a financial collapse and it might soon experience difficulties in servicing its loans as the economy crumbles.&nbsp;</p>



<p>There is absolute incoherence and inconsistency in the public policy priorities. From a glitzy manifesto that has been honoured more in the breach than in the observance, to the Big 4 Agenda, the Nairobi Regeneration Team, the Anti-Corruption, we are all over the place, and are now consumed by succession politics.</p>



<p>All the while, the material conditions of our people are worse than there were during independence because of these baronial elite’s largesse and plunder of public resources.&nbsp;</p>



<p>KLM is determined to change this trajectory by spearheading commissions of Inquiry, on the public debt incurred since independence and will hold a convention to chart a new economic blueprint for the prosperity of Kenyan people.</p>

<p>The COVID-19 crisis has drawn attention to the already overburdened public health systems in Kenya, and to the challenges faced in recruiting, deploying, retaining and protecting sufficient well-trained, supported and motivated health workers.&nbsp;</p>



<p>It has created unprecedented disruption for the healthcare industry, forcing hospitals, organisations fighting infectious diseases, healthcare workers, social services and more to think about alternative ways of delivering medical services while adapting to the new environment.</p>



<p>It has also highlighted the strong need for sustainable investment in health systems, including in the health workforce, and for decent working conditions, training and equipment, especially in relation to personal protective equipment and occupational safety.</p>



<p>More fundamentally, the pandemic has revealed that healthcare can’t be privatized and governments role in provision this public good cant be emphasised.&nbsp;</p>



<p>KLM is committed that all citizens of the nation should have available acceptable public health services, without discrimination, and to push for health reforms to create a minimum national health standard to be set by the state and other national institutions.</p>

<p>The COVID-19 pandemic has revealed vulnerabilities about our education system here in Kenya. While most developed countries moved their classes online with ease, many developing countries have been found wanting, due to a lack of infrastructure, the high cost of data, shortage of well-funded schools, trained teachers, and books and supplies.&nbsp;</p>



<p>Indeed, COVID-19 has left many children in primary and secondary schools out of school. The topic of innovation in education has never been so crucial and the decisions we shall make today will have long-term consequences for the futures of education, our children and our country. Choices must be based on a humanistic vision of education and development, and human rights.</p>



<p>KLM is committed to strengthen education as a common good; expand the definition of the right to education so that it addresses the importance of connectivity and access to knowledge and information; value the teaching profession and teacher collaboration; promote student, youth and children’s participation and rights; protect the social spaces provided by schools as we transform education; expand the avenues of education beyond the classroom and ensure scientific, (liberal) arts and technological literacy within the curriculum that centres the people as the key drivers of progress.</p>
